Another such law is the Civil War-era Insurrection Act, which Bush could have invoked to waive the law enforcement restrictions of the Posse Comitatus Act. That would have enabled him to use either National Guard soldiers or active-duty troops — or both — to quell the looting and other lawlessness that broke out in New Orleans. So what is the problem??? Well, that is exactly how foreign countries control their populations by FORCE... ARE YOU READY FOR THAT AMERICA??? The Insurrection Act lets the president call troops into federal action inside the United States whenever "unlawful obstructions, combinations or assemblages — or rebellion against the authority of the United States — make it impracticable to enforce the laws" in any state. The last time the Insurrection Act was invoked was in 1992 when it was requested by California Gov. Pete Wilson after the outbreak of race riots in Los Angeles. Then President George H. W. Bush dispatched about 4,000 soldiers and Marines.

U.S. Air Force Gen. Gene Renuart, commander of USNORTHCOM, signs agreement Feb. 14, 2008, with Canadian Air Force Lt. Gen. Marc Dumais, commander of Canada Command The agreement, defined as a Civil Assistance Plan, was not submitted to Congress for approval, nor did Congress pass any law or treaty specifically authorizing this military agreement to combine the operations of the armed forces of the United States and Canada in the event of a wide range of domestic civil disturbances ranging from violent storms, to health epidemics, to civil riots or terrorist attacks. In Canada, the agreement paving the way for the militaries of the U.S. and Canada to cross each other's borders to fight domestic emergencies was not announced either by the Harper government or the Canadian military, prompting sharp protest. In Nov. 2007, NORAD-USNORTHCOM Vigilant Shield 2008, an exercise which involved Canada Command as a participant. In an exclusive interview during Vigilant Shield 2008, Gen. Renuart affirmed USNORTHCOM would deploy U.S. troops on U.S. soil should the president declare a domestic emergency in which the Department of Defense ordered USNORTHCOM involvement. ***WATCHMAN... Employing special operations for domestic missions sounds very ominous, and NORTHCOM's request earlier this year should receive the closest possible Pentagon and congressional scrutiny. House Permits Pentagon to Assign U.S. Military Along Mexican Border The Pentagon is looking at ways the military can help provide more security along the U.S. southern border, defense officials said Thursday, once again drawing the nation's armed forces into a politically sensitive ‘domestic’ role. For those worried about the Civil War-era Posse Comitatus Act, where federal troops are prohibited from performing LAW ENFORCEMENT ACTIONS, such as making arrests, seizing property or searching people, be aware that this is an issue of National Security defending against ILLEGAL entry of FOREIGNERS. Operating under the mindset of the use of law enforcement substituted for what should be military operations is a left-over of the disastrous Clintonian administration and should be discarded as quickly as possible.
Posted January 16, 2006 ----------------------------- Bush Could Seize Absolute Control of US Government President George W. Bush has signed executive orders giving him sole authority to impose martial law, suspend habeas corpus and ignore the Posse Comitatus Act that prohibits deployment of U.S. troops on American streets. This would give him absolute dictatorial power over the government with no checks and balances. Posted October 18, 2005 ----------------------------- Military May Propose an Active-Duty Force for Relief Efforts [Active-duty troops may conduct relief operations without the federal government being in charge, but the Posse Comitatus Act of 1878 prohibits active-duty forces from conducting law enforcement missions on American soil.] The military's Northern Command is developing a proposal to organize a specially trained and equipped active-duty force that could respond quickly to assist relief efforts in the event of overwhelming natural disasters, like major hurricanes, floods or earthquakes. The proposal, one of the first results from the military's study of shortcomings in the relief effort after Hurricane Katrina, could resolve significant stumbling blocks to the deployment of active-duty forces into a disaster area on American soil. President Bush has urged Congress to consider laws allowing a greater role for the active-duty armed forces in disaster relief. The force under consideration would keep hundreds of soldiers standing by on short notice to assist National Guard soldiers. The new unit could include military communications technicians, logistics specialists, doctors and nurses, engineers and even infantry. ***WATCHMAN COMMENT... "AND EVEN INFANTRY" The active-duty forces could rapidly fill the gap if state and local police officers, firefighters and local medical personnel were overwhelmed and unable to serve as the first line of relief, as happened during Hurricane Katrina. The idea has not yet been presented to Defense Secretary Donald H. Rumsfeld or to the military's Joint Staff. It was described in an interview by Adm. Timothy J. Keating, the head of the Northern Command, which is in charge of the military's response to threats on American soil. The force would be designed to move in quickly alongside National Guard forces, with whom it would train, rather than taking over the mission. The virtue of such an active-duty unit is that it could swiftly bring important capabilities to bear in a natural disaster on American soil. With all of the operating rules agreed upon in advance, the command of the mission would remain with the National Guard, answering to state governors, putting off any need to debate whether to federalize the operation. In the first days after Hurricane Katrina passed and the levees broke in New Orleans, flooding the city, the Democratic governor of Louisiana and White House officials squabbled over whether the federal government should take command of the faltering relief effort. Active-duty troops may conduct relief operations without the federal government being in charge, but the Posse Comitatus Act of 1878 prohibits active-duty forces from conducting law enforcement missions on American soil. Pentagon and military officials say that federal troops could not have been sent into the chaos of New Orleans without breaking the Posse Comitatus law. That would not be a problem with the standby force as long as it was kept to logistical and relief operations and the mission, in particular law-enforcement duties, remained with the National Guard reporting to the state governors. The federal, state and local authorities would first agree, in advance, on what kind of event would lead to the sending of active-duty forces into a state. The criteria might include predictions of hurricane severity, the level of damage from an earthquake or casualty figures. Admiral Keating said that could help eliminate politics from the calculation. "The success or failure of our effort won't depend on the political dealings between the governors and the president," he said. "We'll just get a mission and we'll execute it." ***WATCHMAN COMMENT... "WE'LL JUST GET A MISSION AND WE'LL EXECUTE IT" Had such a plan been in place when Hurricane Katrina barreled through the Gulf Coast region, a potent active-duty force could have flowed in faster to join National Guard troops, which already have the legal authority to carry out law enforcement duties under state control. But, while some in Congress have urged the Bush administration to reconsider the limits of the Posse Comitatus Act, Admiral Keating said he was wary of the military's role in law enforcement. "I'm not at all convinced that we need to go back and revise Posse Comitatus," he said. "I don't think the American people writ large are anxious to have active-duty forces in a law enforcement role." It is not yet clear how much such a plan would cost or whether the military could spare the money or the troops at a time when it is stretched thin by the wars in Iraq and Afghanistan. Admiral Keating said a contingency force would be loosely modeled on existing rapid-response forces like the ready brigade of the 82nd Airborne Division at Fort Bragg, N.C., which can deploy anywhere in the world in 18 hours, and others that stand ready to deal with domestic terrorist attacks. But he said the new force could be drawn as required from existing units that would still train for and carry out their current combat duties. It would not require the military to create and finance a separate domestic defense force, he said. ***WATCHMAN COMMENT... "DOMESTIC DEFENSE FORCE" Although Mr. Rumsfeld has acknowledged the inadequacies of the Hurricane Katrina relief mission and has said the active-duty military has a sweeping array of capabilities that could be brought to bear, he has taken no public stance on the way ahead. Posted October 13, 2005 ----------------------------- Will Bird Flu Outbreak Bring Martial Law? President George W. Bush asked Congress this week to consider giving him powers to use the military to enforce quarantines in case of an avian influenza epidemic. He said the military, and perhaps the National Guard, might be needed to take such a role if the feared H5N1 bird flu virus changes enough to cause widespread human infection. "If we had an outbreak somewhere in the United States, do we not then quarantine that part of the country? And how do you, then, enforce a quarantine?" Bush asked at a news conference. "It's one thing to shut down airplanes. It's another thing to prevent people from coming in to get exposed to the avian flu. And who best to be able to effect a quarantine?" Bush added. "One option is the use of a military that's able to plan and move. So that's why I put it on the table. I think it's an important debate for Congress to have." Bird flu has killed more than 60 people in four Asian nations since late 2003 and has been found in birds in Russia and Europe. Experts fear that the H5N1 bird flu virus, which appears to be highly fatal when it infects people, will develop the ability to pass easily from person to person and would cause a pandemic that would kill millions. "And I think the president ought to have all ... assets on the table to be able to deal with something this significant," Bush said. He noted that some governors may object to the federal government commandeering the National Guard, which is under state command in most circumstances. "But Congress needs to take a look at circumstances that may need to vest the capacity of the president to move beyond that debate. And one such catastrophe or one such challenge could be an avian flu outbreak," Bush said. The active duty military is currently forbidden from undertaking law enforcement duties by the federal Posse Comitatus Act. That law, passed in 1878 after the U.S. Civil War, does not prohibit National Guard troops under state control from doing police work. But, unless the law is changed, it would keep them from doing so if they were activated by Washington under federal control. While the law allows the president to order the military to take control and do police work in an extreme emergency, the White House has been traditionally reluctant to usurp state powers. Pentagon spokesman Bryan Whitman told reporters he was not aware of any current planning by the military to help respond to a flu pandemic. But he noted that after Hurricanes Katrina and Rita devastated the Gulf region, Bush had asked Congress to consider giving the military control over initial response in dealing with major natural or other domestic disasters. "Obviously the Defense Department has a tremendous amount of capability in a lot of areas. And we are a large force," Whitman said, noting also that the military had deployed field hospitals to Louisiana after the hurricanes. Health experts are working to develop vaccines that would protect against the H5N1 strain of flu, because current influenza vaccines will not. And countries are also developing stockpiles of drugs that can reduce the risk of serious disease or even sometimes prevent infection -- but supplies and manufacturing capacity are both limited. Bush said he was involved in planning for an influenza pandemic, which experts say will definitely come, although they cannot predict when, or whether it will be H5N1 or some other virus. But Dr. Irwin Redlener, associate dean of Columbia University's Mailman School of Public Health and director of its National Center for Disaster Preparedness, told The Associated Press the president's suggestion was dangerous. Giving the military a law enforcement role would be an "extraordinarily Draconian measure" that would be unnecessary if the nation had built the capability for rapid vaccine production, ensured a large supply of anti-virals like Tamiflu and not allowed the degradation of the public health system. There was nothing spontaneous in the White House journalist's question to President Bush, which explicitly pointed to a role for the country's "defense assets" in the case of a pandemic. We are not dealing with an off-the-cuff statement. Both the question as well as Bush's response calling for a greater role of the Military, had been prepared in advance Posted October 7, 2005 ----------------------------- Military's Role in a Flu Pandemic President Bush said yesterday that he would consider using the military to "effect a quarantine" in the event of an outbreak of pandemic influenza in the United States. Responding to a question during a news conference, Bush also suggested that putting National Guard troops under federal, rather than state, control might be one part of a response to the "catastrophe" of an avian influenza outbreak. The president raised the same idea after Hurricane Katrina, suggesting that he is considering a greater role for the military in natural disasters. The president gave no details on the specific role troops might play or what sort of quarantine might be invoked. The federal government's pandemic-response plan, the product of more than a year of work, is expected to be released soon. Most public health experts believe it is impossible to entirely isolate neighborhoods, towns, cities or regions during an outbreak of disease. Instead, quarantines today generally refer to a variety of strategies for identifying and limiting the movement of people who are infected with a contagious pathogen or are at high risk. That might include screening travelers for fever and flu symptoms; prohibiting large gatherings of people, including at some workplaces; and requiring that people exposed to infected individuals stay at home until the incubation period for the illness has passed. China took these measures during the outbreak of severe acute respiratory syndrome in 2003. "The policy questions for a president in dealing with an avian flu outbreak are difficult," Bush said. "One example: If we had an outbreak somewhere in the United States, do we not then quarantine that part of the country? And how do you, then, enforce a quarantine? . . . And who best to be able to effect a quarantine?" He did not answer his own questions, but after the last one, he said: "One option is the use of a military that's able to plan and move. So that's why I put it on the table. I think it's an important debate for Congress to have." The president said some governors object to the idea of federal control of state National Guard units in emergencies. He added that, as a former governor, "I understand that. . . . But Congress needs to take a look at circumstances that may need to vest the capacity of the president to move beyond that debate. And one such catastrophe or one such challenge could be an avian flu outbreak." A strain of avian influenza called H5N1 has led to the death of more than 140 million birds in Asia. It has infected 116 people, of whom 60 have died. The government is stockpiling antiviral medications and an experimental "bird flu" vaccine as a defense against the virus, should it develop the capacity to spread easily and quickly in human beings. Yes, on face value it seems reasonable and good but there may be a sinister reason behind what appears to most to be OK - BEWARE... Historic changes possible in military's role in domestic emergencies President Bush's push to give the military a bigger role in responding to major disasters like Hurricane Katrina could lead to a loosening of legal limits on the use of federal troops on U.S. soil. Pentagon officials are reviewing that possibility, and some in Congress agree it needs to be considered. Bush did not define the wider role he envisions for the military. But in his speech to the nation from New Orleans on last week, he alluded to the unmatched ability of federal troops to provide supplies, equipment, communications, transportation and other assets the military lumps under the label of "logistics." The president called the military "the institution of our government most capable of massive logistical operations on a moment's notice." At question, however, is how far to push the military role, which by law may not include actions that can be defined as law enforcement — stopping traffic, searching people, seizing property or making arrests. That prohibition is spelled out in the Posse Comitatus Act of 1878, enacted after the Civil War mainly to prevent federal troops from supervising elections in former Confederate states. Speaking on the Senate floor Thursday, Sen. John Warner, R-Va., chairman of the Armed Services Committee, said, "I believe the time has come that we reflect on the Posse Comitatus Act." He advocated giving the president and the secretary of defense "correct standby authorities" to manage disasters. Presidents have long been reluctant to deploy U.S. troops domestically, leery of the image of federal troops patrolling in their own country or of embarrassing state and local officials. The active-duty elements that Bush did send to Louisiana and Mississippi included some Army and Marine Corps helicopters and their crews, plus Navy ships. The main federal ground forces, led by troops of the 82nd Airborne Division from Fort Bragg, N.C., arrived late Saturday, five days after Katrina struck. They helped with evacuations and performed search-and-rescue missions in flooded portions of New Orleans but did not join in law enforcement operations. The federal troops were led by Lt. Gen. Russel Honore. The governors commanded their National Guard soldiers, sent from dozens of states. ***WATCHMAN COMMENT... If saw the YV appearances of Lt. Gen. Defense Secretary Donald Rumsfeld is reviewing a wide range of possible changes in the way the military could be used in domestic emergencies, spokesman Lawrence Di Rita said Friday. He said these included possible changes in the relationship between federal and state military authorities. Under the existing relationship, a state's governor is chiefly responsible for disaster preparedness and response. Governors can request assistance from the Federal Emergency Management Agency. If federal armed forces are brought in to help, they do so in support of FEMA, through the U.S. Northern Command, which was established in 2002 as part of a military reorganization after the 9/11 attacks. Di Rita said Rumsfeld has not made recommendations to Bush, but among the issues he is examining is the viability of the Posse Comitatus Act. Di Rita called it one of the "very archaic laws" from a different era in U.S. history that limits the Pentagon's flexibility in responding to 21st century domestic crises. ***WATCHMAN COMMENT...Mr. Di Rita what part of the protections of American Freedom guarantee by the Posse Comitatus Act of 1878 Another such law, Di Rita said, is the Civil War-era Insurrection Act, which Bush could have invoked to waive the law enforcement restrictions of the Posse Comitatus Act. That would have enabled him to use either National Guard soldiers or active-duty troops — or both — to quell the looting and other lawlessness that broke out in New Orleans. The Insurrection Act lets the president call troops into federal action inside the United States whenever "unlawful obstructions, combinations or assemblages — or rebellion against the authority of the United States — make it impracticable to enforce the laws" in any state. ***WATCHMAN COMMENT... Are you ready for that American??? The political problem in Katrina was that Bush would have had to impose federal command over the wishes of two governors — Kathleen Blanco of Louisiana and Haley Barbour of Mississippi — who made it clear they wanted to retain state control. The last time the Insurrection Act was invoked was in 1992 when it was requested by California Gov. Pete Wilson after the outbreak of race riots in Los Angeles. President George H.W. Bush dispatched about 4,000 soldiers and Marines. Di Rita cautioned against expecting quick answers to tough questions like whether Congress should define when to trigger the president's authority to send federal troops to take charge of an emergency, regardless of whether a governor agreed. "Is there a way to define a threshold, or an anticipated threshold, above which a different set of relationships would kick in?" Di Rita asked. "That's a good question. It's only been two weeks, so don't expect us to have the answers. But those are the kinds of questions we need to be asking." ***WATCHMAN COMMENT... So what is the problem??? Inevitably, national governments yield to the temptation to use the military to do the heavy lifting... Once the military is used, however minor initially, the march toward martial law … becomes irresistible.” Fast-forward to the present. In the wake of Hurricane Katrina, General Peter Grace, soon to become Vice Chairman of the Joint Chiefs of Staff, has called “for Posse Comitatus to be reconsidered in response to suggestions that it slowed down deployment of troops,” according to Jurist, a legal research website. Virginia Republican John Warner, chairman of the Senate Armed Services Committee, “has questioned restrictions under the law since the September 11th attacks, and has promised to do so again.” In February, 2002, soon after the nine eleven attacks, Colonel John R. Brinkerhoff, US Army Retired, and acting associate director for national preparedness of the Federal Emergency Management Agency (FEMA), wrote... “President Bush and Congress should initiate action to enact a new law that would set forth in clear terms a statement of the rules for using military forces for homeland security and for enforcing the laws of the United States. Things have changed a lot since 1878, and the Posse Comitatus Act is not only irrelevant but also downright dangerous to the proper and effective use of military forces for domestic duties.” “Article II, Section 2 of the Constitution grants the power to Congress to make the rules governing the armed forces,” writes Diane Alden. “In recent years Congress has acted less like the source of legitimacy for the use of the military force and more like a rubber stamp for military adventurism by the executive branch, regardless of who is president ... both Republicans and Democrats can share the blame for blurring lines between the military and police…. Both can share blame in the unconstitutional laws passed and the open checkbook they offer federal police agencies that don’t seem to be concerned with the niceties of the Bill of Rights.” Alden wrote this in the 1990s, during the Clinton administration and after the outrage of Waco. Her words are even more urgent today as Bush and Congress have eroded the Constitution and the Bill of Rights even further. Our corporate media has blamed FEMA’s response to Katrina on bureaucratic inertia and ineptitude. However, a cursory examination of events reveal something else: FEMA (and the Department of Homeland Security) deliberately exacerbated the situation in New Orleans and up and down the Gulf Coast by withholding crucial assistance, thus creating a chaotic situation and “anarchy” in the streets as desperate people “looted” stores in search of water and food. FEMA turned away experienced firefighters; turned away Wal-Mart supply trucks; prevented the Coast Guard from delivering diesel fuel; prevented the Red Cross from delivering food; blocked morticians from entering New Orleans; blocked a 500-boat citizen flotilla from delivering aid; turned away generators; told first responders not to respond. As Jefferson Parish President Aaron Broussard revealed during an emotional plea on NBC’s Meet the Press, FEMA basically declared war on local authorities and sabotaged local communications. FEMA went out of its way to make the situation worse, thus sending the message: without military occupation and a watering down of the Posse Comitatus Act, FEMA and the feds cannot do their job, a message dutifully echoed by the corporate media. “The Posse Comitatus Act reflects the political sensitivities of a period in American history when Union troops enforced laws on the former Confederate states,” opines the San Antonio Express-News. It also reflects the American concept of federalism and a traditional distrust of powerful government. Hurricane Katrina sheds new light on these subjects. Emergency-management planning is now inextricably linked with national security. The military is, in effect, a first responder for both humanitarian relief and law enforcement. The federal government may be the only source of available help in some disaster situations. Congress and the American people will examine what went wrong in the homeland security bureaucracy and why the federal government was slow to respond to Katrina’s destructive force. They also need to examine the Posse Comitatus Act to make sure it—or at least government lawyers’ understanding of it—does not remain an obstacle to common-sense response to national disasters. If the Posse Comitatus Act is an obstacle to anything, it is the federal government’s desire send in the Marines—who are trained to fight wars, not provide disaster relief and augment (or supplant) local law enforcement. “One of the United States’ greatest strengths is that the military is responsive to civilian authority and that we do not allow the Army, Navy, Marines or the Air Force to be a police force,” Marine Corps General Stephen Olmstead testified before Congress. “History is replete with countries that allowed that to happen. Disaster is the result.” Or, as Maryland delegate Luther Martin argued during the Constitutional Convention in 1787, “When a government wishes to deprive its citizens of freedom, and reduce them to slavery, it generally makes use of a standing army.” “If this were a dictatorship, it’d be a heck of a lot easier, just so long as I’m the dictator,” Bush joked on December 18, 2000. However, as we have witnessed since, Bush was not joking and the result of his desire to be a dictator has resulted in a serious erosion of the Bill of Rights, most notably the First, Second, Fourth, and Six Amendments. Indeed, if the barriers to military rule are removed by Bush’s rubberstamp Congress, and the American people are not vigilant, “slavery,” as Luther Martin noted, will be the ultimate result
